The man trying to stop the Springboks from leaving South Africa needs to find a lawyer, a judge cautioned him on Wednesday, as he is jumping into waters where there are “fish that bite”.
“You may find that you are traversing an area which is like a pond on the surface. It looks calm, but underneath the waters flow with tremendous force, if you are not familiar with that terrain,” Judge Ntendeya Mavundla cautioned Tshidiso Mokhoanatse.
He was referring to the debate about transformation in sport, and society in general.
The leader of the Agency for New Agenda party was about to jump into the deep end and tackle the case on his own, when Mavundla advised him it would be best to get a “scuba diver” to help him.
Mavundla stood the matter down until 14:00 SA Time for a lawyer from the Bar Council or Law Society to help him.
A lawyer promptly rose and told Mavundla he was available. He was 1 of 6 senior members of the Bar Council, but 1st needed to discuss the matter with its chair and deputy chair.
Mokhoanatse wants the High Court to stop the Springbok rugby team from competing in the Rugby World Cup, as he says rugby administrators and the sports minister have failed in their constitutional duty to include more black players.
What a tool!
He case was not even headed up by Legal Representatives.
The saying goes: “A man who acts as his own attorney, has a fool for a client!”
I hope the Judge orders costs against him too….. fool!
I would hate to see what his High Court Motion Application papers look like, and how a non-lawyer like him proceeds to try and build a case where there is none in the 1st place.
The only thing he has in his favour is that the Rules which pertains to URGENCY in High Court matters, gives him some leeway in terms of the format of the papers and procedures… but you still have to be able to make a case in Law and cover the fundamentals of relevant facts to have any chance to succeed.
He already brought / filed the Application on Friday, before the Springbok squad was even announced, which in itself makes the whole Application premature and without any existing Cause of Action at the time of bringing it.
Laughable, really!
Now some asswipe Advocate, from the Pretoria Bar Council is going to get permission from Bar Council Members to represent him, probably for free… to also hit some newspaper headlines.
When you go to a gun fight, you do not rock up there with a little pocket knife, dressed in your pajamas!
What Law or Case Law, Common Law or Legal Presidents is he going to rely on, when some of the most basic and ensconsed rights in terms of our Constitution is Freedom of Movement, Freedom of Association and EQUAL RIGHTS to all?

If Tshidiso wins (extremely unlikely I know).
Then you can always claim, that if SA HAD attended RWC 2015, you would have won anyway……………………………………just as Louis Luyt claimed you would have won in 1987.
That way, you get to boast that you would now have won 4 RWC’s,
if circumstances had not conspired against you.

The problem is the road to the final after the Pool stages.
We’ll get a real biggie in the Quarters, if we advance we are likely to cop you lot in the semi… and then it will be the final.
Would maybe have been better to be in a strong Pool, to have better chances in the quarters and semi, to an extent.
Springboks start off against Japan, All Blacks start off against Namibia… there should be no doubt about those 2 outcomes.
Springboks get bloody Samoa every time in their World Cup pool… and those buggers like nothing better than monster-tackling, quite often illegally so. So, I worry about injuries.

Some people will do anything for their 5 minutes of fame. Seems like he had a tolerant yet firm judge in his case. Thank goodness he withdrew his application.

Why is it in SA just before the RWC, we get plagued by these sideshows that distract us from the actual event? Its bad enough that last time round we had a coach who fancied himself as a comedian, and this time round our coach seems to have a plan, but that he himself is not sure of.
