Jaque Fourie might have won his arbitration case against the GLRU, and Louis Ludik and Willem Alberts have shown interest on moving to the Sharks, but everybody seems to be missing what is really wrong in this whole debacle.
No PROVINCE, CLUB or UNION is allowed to approach any player, or enter into negotiations with a player without the written consent of the current union of the approached player.
The only scenario where a player can be approached without consent, is if it’s within 120 days of the expiry of the player’s current contract.
This was not the case with Fourie, Ludik or Alberts.
At no point, did either Province or the Sharks, ask for written consent from the GLRU, and as SARU regulations stipulate, any Province approaching a player without written consent is in breach of SARU regulations.
EXTRACTS FROM THE SOUTH AFRICAN RUGBY UNION REGULATIONS PLAYER STATUS, PLAYER CONTRACTS AND PLAYER MOVEMENT
An intended Transferee who wishes to negotiate the terms and conditions of the movement of a Player contracted with an intended Transferor or before the Player’s contract has expired, shall in writing request permission from the intended Transferor to enter into negotiations with the Player concerned or his Agent. No negotiations, directly or indirectly, are permissible prior to obtaining the said permission.
An intended Transferee may negotiate the transfer of a Contract Player from an intended Transferor to an intended Transferee and may enter into negotiations with the Player concerned within a period of 120 days prior to the expiry date of a Player’s contract, without seeking any permission as set out above.
A Province, Club, Player or Agent may file a written complaint concerning the breach of these regulations to the CEO with notice to the alleged offender. It is the duty of a Province and Club to investigate, as soon as it is reasonably practicable, each and every alleged breach of these regulations within its jurisdiction and to report its findings to the CEO in writing.
Should any Province, Club, Player or Agent be in breach of any of these regulations, the matter shall be adjudicated in accordance with the provisions of the Disciplinary and Judicial Matters Regulations.
A Province, Club, Player or Agent which is found to have been in breach of any of these regulations, shall be guilty of an offence and subject to sanction as provided for in the Disciplinary and Judicial Matters Regulations.
Why the GLRU have not yet investigated or requested an investigation into this matter is a mystery. The Sharks and Province should, and must answer to a Judicial disciplinary and must be found guilty.
No regulations were followed and the integrity of the Sharks and Province must be questioned. At no point did they respect the regulations that was put in place for a reason. The GLRU, no matter what they do, always seem to get the blame for being unproffesional and incompetent. It does seem to raise questions why the Lions and Bulls, have managed to maintain a mutual relationship, in respect of loaning players, and contracting from one another. It’s done above board, and the system and regulations are respected.
Maybe it’s time for unions like the Sharks and Province to look at their own home and decide if they are acting in the true spirit of the game.
Maybe the sharks did not approach Ludick and Alberts………. Maybe they (Alberts and Ludick) approached the sharks.

Die probleem wat SARU het is dat as jy een unie (WP) daarmee laat wegkom, kan jy sekerlik nie die volgende unie (Sharks) skuldig vind nie.

Spelers sal gou hul kant bring sodra hul weet hulle moet bly. Kyk hierdie ouens verdien nie kleingeld nie. Versekker sal hulle hul kant bring as hulle by die Leeus moet bly. Wat se pay trek hulle nie R20 000 per maand nie seker meer as R50 000 p/m. sal jy daai pay kan los.
Die 120 dae reel geld nie as daar geen kontrak is nie.
As die kontrak nie afdwingbaar is nie is die spelers fair game.
Laat egter n wrang smaak.

Maar as jy pay vat van die unie sonder om enige dispuut te verklaar stem jy nie dan saam met die kontrak nie, al is hy nie geteken nie? Die ding werk tog seker na twee kante.
Kyk die reg ken ek nie maar wat ek weet deesdae “dispute” jy enige ding. In my jong dae het jy baie op goedertrou gehandel, en jou woord was soos n kontrak.
Snoek, die enigste rede hoekom die kontrakte ongeldig verklaar was, is omdat in die 2010 salarisse, gesit is “to be negotiated”. Dit was op versoek van Peet van Zyl.
Hulle het gese hulle wil hulle nie an n salaris bind nie, want die speler se markwaarde gan op, dan kan hulle dit hersien vir die volgende jaar en bevestig. Dis al hoekom die kontrak ongeldig verklaar is. Dit het niks uit te waai met die feit dat die Leeus nie die standaard SARPA kontrak gebruik het nie.
Dis op verskoek van van Zyl so gemaak, en die Leeus het dit aanvaar in goeie gees, en dis presies wat hulle in die gat gebyt het, snaaks genoeg is van Zyl, Ludik en Alberts se agent ook.
Super – die hele affere moes anders hanteer word.
As JF wou waai moes hulle eerder n release beding het maar wou nie.
Toe raak dit nasty en enige loophole sal gesoek word.
Feit is dat GLRU te stupid was om dit uit te sort.
Toe die probleem die 1ste keer surface moes hul al die spelerskontrakte nagegaan het en met die wat daar fout was gepraat het en hul ondersteuning gekry het en nuwe kontrakte aangegaan het.
Maar hulle wou mos eerder baklei…

‘n Topklas organisasie sal homself weerhou om by betwyfelagtige sake betrokke te raak. WP en Natal het besluit om daarby betrokke te raak. Dit is hoekom die spelers voortgaan daarmee.
‘n Paar weke gelede was daar ‘n “live chat” met Barend van Graan, CEO van die Bulle, op die Bulle se webtuiste gewees. Een van die vrae aan Barend was spesifiek oor ‘n onderhandelings van die Bulle met Jaque Fourie gewees. Barens se antwoord was dat hulle Jaque se kontrak as geldig aanvaar. Dit is wat ‘n topklas organisasie doen.
Dit is wat die Sharks en die WP moes gedoen het.

I feel sorry for the Lions. Ludik, Mossie and Alberts are the best players.
WP and the Sharks couldve respected their “contracts”. But legally, the Lions screwed up by not contracting them properly. Hopefully they, and other unions will learn from this. Draw up the contract properly, because other unions will exploit the smallest loophole.
Supa, I too feel for the Lions. Then we really don’t know for sure if Ludick and Alberst are going to the Sharks. So far it is all rumours until we see them in a Sharks jersey.
Same for Brussow he is also supposed to be going to the Sharks, but we all know he has signed with the Cheetahs last year until 2010. Until I see him in a Sharks jersey then I will only believe he is a Shark too. Until then it is all rumours.
