Jaque Fourie does not have a standard players contract with the Golden Lions Rugby Union (GLRU) and that is just one of the reasons he believes his agreement with the union is not binding. He is also believed to be tired of having to play above himself to carry the Lions along with a handful of team-mates, and is said to be tired of the losing culture of the union. Fourie wants to leave the Lions to join Western Province, so that he can play for the Stormers next year.

Arbitration in the dispute between Fourie and the GLRU ended in Johannesburg on Tuesday, but a finding is only expected early next week. Information at Sport24’s disposal suggests that Fourie has a strong case.

The collective agreement between the South African Rugby Players’ Association (Sarpa) and the South African Rugby Employers Organisation (Sareo) determines that rugby unions must enter into agreements with players on standard players contracts.

Sports24 revealed the following:

-Fourie does not have a standard players contract with the union. He did, however, enter into an agreement with them on August 11, 2008.

– Sareo already on June 26, 2008 sent the standard players contract and new collective agreement to rugby unions, and there was no reason for the GLRU to not apply it to Fourie.

– The agreement that Fourie reached with the GLRU does not stipulate his remuneration for the second year of the so-called contract. Furthermore, the terms of his remuneration such as allowances, deductions, match fees and bonuses have not been filled in.

 – Fourie’s contract with the GLRU indicates that he has been appointed as a “professional analyst” and not a rugby player.

The Springbok centre believes his relationship with the GLRU has broken down because he was prevented from joining French club Clermont earlier this year and his salary for next season was not revised.

Fourie apparently followed grievance procedures, but talks with Lions chief executive Manie Reyneke and union consultant Jake White did not solve the problems.

He is tired of the losing culture at the union, which is preventing him from reaching his professional, personal and financial goals.

Sarpa chief executive Piet Heymans called on rugby unions and player agents to use the standard players contract.

“All the parties have to do on the standard players contract is to fill in the remuneration and the term. The rest is determined by a broad process of negotiations between Sarpa and Sareo. The provinces should take cognisance of the collective agreement, of which the standard contract is an attachment,” said Heymans.

 Sport24 has learned that six Lions players do not have standard contracts. Willem Alberts and Louis Ludik are also among them. Both have offers from the Sharks.

    But did he deserve a stellar, eight- or nine-out-of-10 individual rating in overall terms? A niggling part of me was determined to proceed with judgmental caution.

    We saw a lot of “flash” from the No 5, after all, and while several of his sprinting sortees were undoubtedly easy on the eye and valuable to his side, you also have to consider the bigger picture.

    Province, after all, lost the match – a rather key fact. And they lost it, in many respects, because they were taken a little by surprise by the collective muscle and endeavour of a Lions pack featuring few luminary names but a praiseworthy, get-down-and-dirty, all-hands-to-the-pump ethic.

    To a moderate extent, the much-vaunted, supposedly resurgent WP scrum got a come-uppance, bulldozers like Willem Alberts made forceful yards for the Lions in the tight-loose and Bekker’s presence also wasn’t enough to prevent the visitors losing some lineouts off their own throw.

    It is probably too simplistic and possibly even statistically unfair – coaches love to throw bamboozling figures at you when they’re indignant about your assertions – to suggest that Bekker spent too much time loitering in the backline.

    This might be deemed an indignity … a bit like castigating a fireman for directing traffic past the fire engine while his colleagues battled a mushrooming flame-front.

    But it wasn’t the first time, even if the perception may be cruelly exaggerated, that Bekker probably made himself susceptible to charges of his favouring linking up with the three-quarters to earthier, more primary tasks in the engine room.

    Was it a coincidence that, with Bekker back in the second row and the uncompromising Chris Jack now a fading memory, Province couldn’t get their previously machine-like eight-man shove or rolling maul working very smoothly at Coca-Cola Park?

    Die ding is FDP speel 80min. So of Hougaardt speel vleuel en kry gametime vir 60-80min, of hy sit op die bank en speel dalk 5min.
    Hy het al twee jaar terug klomp s14 games gespeel en hy weet hy is agter FDP in die ry. FDP is die beste skrummie in die wereld.

    Hougaardt speel eintlik net scrummie en vleuel. Hyt een game op senter uitgehelp toe ons beserings gehad het.
    Bulle het al gereeld scummies op vleuel gespeel. Joost, Conrad Breytenbach ens.
    Ek sal graag Hougaardt om scrummie wil sien, maar FDP is eenvoudig beter. Hy kry minstens nou gametime op vleuel en scrummie.

    Ek rate ook nie WP se scrummies nie, maar ons albei WEET Ricky gaan altyd daar in die mix wees en hulle speel Duvenhage ook baie. Hougaardt gaan nie net daar instap en sommer net begin nie. Cheetahs is sy beste roep, maar gaan 10 teen heelwat minder geld kry en hoekom n plek in die s14 span van die Bulle verruil vir n n plek in die Cheetah span? Bulls het minstens n kans om die toernooi te wen volgende jaar.
