Cape Town – The tug-of-war over Jaque Fourie has taken a new twist, with French club Clermont reportedly considering action against the Springbok centre after he decided against joining them.

“The debate is moving to the legal side, it is going to be sorted out between lawyers. By principle, we are going to go as far as possible,” Clermont vice-president Jean-Marc Lhermet reportedly told French daily newspaper L’Equipe.

Clermont claim to have a letter in their possession which ties Fourie to the club for the coming season.

However, Fourie’s attorney, Frikkie Erasmus, laughed off the planned action and predicted that it would amount to nothing.

“I already made it clear in correspondence with Clermont on July 20 that Jaque has no intention of joining them,” said Erasmus.

“Clermont also breached International Rugby Board regulations by negotiating without written consent from Fourie’s province.”

According to Erasmus, the only document signed by Fourie is one in which he acknowledges a letter that Clermont sent him in February.

It is stated in this letter that they intend employing him subject to a contract being agreed at a later date. However, no contractual agreement was reached.

Fourie therefore does not have a binding agreement with Clermont. He has subsequently decided that he wants to join Western Province.

However, the Golden Lions Rugby Union (GLRU) maintain they have a binding contract with Fourie until the end of October 2010. They have stated that they have no intention of releasing him.

Erasmus has written to the GLRU’s attorneys to enquire why the union has not yet reacted to Fourie’s request for a release.

“Jaque requested a release on August 6, but has not had any feedback,” said Erasmus.

    Is Erasmus a moron? In one breath he condemns Clermont for talking to the player without the GLRU’s permission, but he is thying to get the GLRU to release the player after WP did the same thing!

    The GLRU will not release him. Kevin de Klerk is not like the softies that went before him. He’ll make him sit on the sidelines for a year if he needs to.

    The concensus (at the GLRU) is that a precedent needs to be set. There will be no more “soft” poaching of GLRU players.
